Polo St. Moritz

1. General
The following general terms and conditions alone shall govern the business relations between St. Moritz Polo AG and the ordering party, hereinafter called Customer. Use by the Customer of the websites poloshop.ch, polostmoritz.com or polostmoritz.ch shall constitute full acceptance of these general terms and conditions. Orders shall become binding on sending confirmation of order.

2. Supply
Supply shall take place within two working days, in the form of dispatch by post. If individual products are out of stock, or no longer obtainable, the Customer shall be contacted within two working days and notified of the foreseeable date of delivery.

3. Prices
The right to amend prices and conditions of order and supply, pending confirmation of an order by Ender Sport or poloshop.ch, is hereby reserved. All prices shall be net and include the statutory Swiss value-added tax (rate as of 1 January 2011: 8%).

4. Dispatch costs
Dispatch costs (postage), declaration and customs fees shall be for the Customer’s account in full. The flat rates for dispatch and packing (up to four shirts) shall be as follows:

• Switzerland and the Principality of Liechtenstein: CHF 15.00
• Europe: CHF 30.00
• Rest of the world: CHF 35.00

If the actual dispatch costs exceed the amounts quoted by more than 10%, St. Moritz Polo AG hereby reserves the right to pass on the difference. Transport insurance shall only be taken out by written instruction of the Customer.

5. Payment
Supply shall take place against debit of the credit card supplied by the Customer, given the necessary validity. Costs incurred through return or non-acceptance of the supply shall be for the Customer’s account.

6. Data protection
Data protection is very important to St. Moritz Polo AG. As a visitor to poloshop.ch, polostmoritz.com or polostmoritz.ch, you shall decide what information you wish to disclose to us. In principle, your visit to poloshop.ch, polostmoritz.com or polostmoritz.ch shall leave behind no personal data without your express consent. In some cases, e.g. orders, we shall need your name and address. If certain personal particulars, such as your e-mail address, are also necessary, we shall point this out to you in due form. If we receive data from you via the Internet and/or by e-mail, we shall treat them as confidential in the following terms. Please note that such data shall be forwarded to the named service providers. We also reserve the right to use your particulars for marketing purposes or to commission a third company to execute a specific project for us, e.g. market research or evaluation of a competition. Any other use of your personal particulars, especially sale to third parties, is hereby expressly excluded.

7. Cookies
Cookies are small pieces of data which a website can send to your browser to support you better in database-supported systems. You do, however, have the option of setting your browser to notify you if you receive a cookie, or automatically to reject it. Thus you can decide yourself whether to accept this. However, non-acceptance of a cookie shall mean that you cannot set up a personal account at poloshop.ch, polostmoritz.com or polostmoritz.ch and cannot shop online.

8. Security
Your credit card details shall be encrypted by tried SSL technology and transmitted encoded to the authorised recipient. Your credit card details shall be stored in no database.

9a. Complaints about defects
Complaints about defects can only be acted on if made in writing within five days of receipt of the goods.

9b. Returns
Goods shall be returned unworn, unwashed, in pristine and original condition. If the item objected to is available in the same version, it shall be replaced within two working days. If the item is no longer in store, the Customer shall receive a credit note.

10. Place of performance
The place of performance for supplies of goods and for your payment of the purchase price shall be the place of business of Ender Sport in St. Moritz, unless expressly otherwise agreed.

11. Jurisdiction
The contracts entered into with Ender Sport shall be governed by Swiss law. The place of jurisdiction shall be St. Moritz, Switzerland.
